There is _no_ problem regarding the sale of "Royal Red". You simply do not
_sell_ it.

As to the proprietorship of the PVR plant, that simply means that no-one
can _sell_ (make a profit from it) on the open market, unless they are
licenced by the people, company, or corporation that holds the copyright or
PVR.

The _biolological_ solution is to have a plant that has the same
characteristics as a PVR plant (ie: all red), but is genetically different.
We have that now. There are "all red" VFTs, but, supposedly not "Royal Red"
VFTs, being distributed freely.
